WebTNG Academy Terms and Conditions of Use

1. Terms
These Conditions and Terms of Use apply to the use of the learning program WebTNG Academy https://webtng.heightsplatform.com (the “program”). By accessing this program you are agreeing to be bound by these Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this program.
2. Intellectual Property
This program and its entire contents (including but not limited to all information, text, displays, images, video, audio, and their arrangement) are owned by WebTNG or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
2. Security and Access
You agree to not use any robot, spider, or other automatic device, process, or means to access the program for any purpose, including monitoring or copying any of the program materials. You agree not to use any manual process to monitor or copy any of the program material for any unauthorized purpose without our prior written consent.
To access this program or some of the resources it offers, you may be asked to provide certain registration details or other information. It is a condition of your use of the program that all the information you provide on the program is correct, current, and complete. You agree that all information you provide to register with this program or otherwise is governed by our Privacy Policy, and you consent to all actions we take with respect to your information consistent with our Privacy Policy.

WebTNG has the right to disable any user name, password, or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms and Conditions of Use.
3. Use License
These Conditions and Terms of Use permit you to use the program for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material from this program, except as follows:
This is the grant of a license, not a transfer of title, and under this license you may not: modify or copy the materials; use the materials for any commercial purpose, or for any public display (commercial or non-commercial); attempt to remove or circumvent security features; remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or ‘mirror’ or display the materials on any other website or server. This license shall automatically terminate if you violate any of these restrictions and may be terminated by WebTNG at any time.

WebTNG makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, WebTNG does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the program materials or otherwise relating to such materials or any claims or representations on any sites linked to this program.
5. Limitations
WebTNG is under no obligation to provide uninterrupted access to this program. We reserve the right to restrict your access to this program at any time and for any reason. In no event shall WebTNG or its partners be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials in this program, even if WebTNG or a WebTNG authorized representative has been notified orally or in writing of the possibility of such damage. To the fullest extent permissible by law, we exclude any and all liability to you resulting from your use of the program or connected to these Terms and Conditions of Use.
6. Accuracy of materials
The program materials could include technical, typographical, or photographic errors. WebTNG does not warrant that any of the materials in its program are accurate, complete or current. WebTNG may make changes to the materials contained in the program at any time without notice. However WebTNG does not make any commitment to update the program materials.

WebTNG has not reviewed all of the sites linked to its program materials and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by WebTNG. Use of any such linked website is at the user’s own risk.

9. Modifications
WebTNG may revise these terms of service for its program at any time without notice. By using this program you are agreeing to be bound by the then current version of these terms of service.
10. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the State of Iowa in the United States of America and you irrevocably submit to the exclusive jurisdiction of the courts in Iowa.
